Diplomatic Escape Clause
All leases should include a diplomatic escape clause. The period of notice will have to be negotiated. Thirty days is preferable.
It is imperative that the name of the relevant city be inserted in the clause in respect of leases concerning Consular premises. If the lease concerns Diplomatic premises, the name of the host country should be inserted.
Where possible, residential lease agreements should also include an escape clause whereby the Government reserves the right to terminate the lease on thirty (30) days notice if the officer occupying the leased residence is posted elsewhere.
Lease agreements should also include a clause whereby the Government reserves the right to terminate the lease on thirty (30) days notice if the Lessor has not honoured repairs and maintenance obligations. (An appropriate rule of thumb is if funds required exceed 10 per cent of monthly rental).
