English term or phrase: positive assets

Under the Decree special rules applies for so-called "small" branches. In case the assets which can be attributed to the branch do not exceed the amount of € 500 mio. XXX German Branch would qualify as "small" branch. In this case the German tax authorities accept a branch capital in the amount of 5 % of the branch's positive assets as notional capital for tax purposes
