Dunque, il testo è tratto da uno studio sulla trasposizione, negli stati membri, delle direttive EU WEEE e RoHS riguardanti la gestione dei rifiuti, studio affidato alla società inglese Perchards. Lo stralcio che tu riporti riguarda la Germania, in cui le industrie hanno creato il DSD (Duales System Deutschland), una società per azioni che finanzia società che assicurano lo smistamento e il riciclaggio di rifiuti ( in Germania, vige il sistema della responsabilità del produttore, per cui i costi del recupero e del riciclo ricadono sui produttori degli imballaggi, sui produttori dei prodotti imballati e sui dettaglianti).

Ora, si è riscontrato che i regimi di responsabilità del produttore hanno, in alcuni casi, creato delle tendenze monopolistiche, e quindi hanno danneggiato la concorrenza.
L'autorità garante tedesca per la concorrenza è intervenuta nei confronti del DSD, le cui azioni, prima in mano ai produttori di imballaggi ( i quali avevano l'obbligo legale di raggiungere i target di recupero e riciclo stabiliti per legge)sono ora in mano alla società finanziaria Kohlberg Kravis Roberts, sicché il DSD sarà quotato in borsa al più presto.
