equity (law)

The body of rules developed by the Court of Chancery to achieve a fair result in cases in which the application of common law would fail to do so. The historical distinction between the common law and equity is due to the failure of the common law to provide a remedy in certain cases, bringing about the custom of applying for redress to the king, who referred the question to the Lord Chancellor\'s court. Here the rules of equity developed separately from but by the same method (judicial precedent) as the common law. The two systems were amalgamated in 1875 with the establishment of the High Court of Justice. Now all courts of law administer both law and equity, the rules of equity prevailing if in conflict with the common law. See also natural justice.

Dziekuje. We "Wspolczesnych kulturach prawnych" Tokarczyka mowi sie o "orzecznictwie oprartym na poczuciu s?usznosci", ale ja potrzebowalem wlasnie takiej zwiezlej nazwy. Do Jaslana akurat nie zajrzalem!

Mimo to w bardzo dużym uproszczeniu: zasada słuszności wprowadzała do common law nieznany wczesniej element prewencyjnego oddziaływania prawa. Przed wprowadzeniem tej zasady nie można było nikogo ukarać za usiłowanie kradzieży lub zaniechanie jakiejś czynności, gdyż kara i ew. odszkodowanie przewidziane były tylko dla czynów popełnionych.
Zasada słuszności zmieniła ten stan rzeczy.

Mam nadzieję, że prawnicy nie zrobią mi krzywdy ;-)

The legal principle of equity is indeed "zasada slusznosci" or "aequitas" .

Both concepts are very commonly confused.
