English term or phrase:Deed of Novation
I am assisting in the editing of a translation of a deed of novation. It involves two Canadian companies and one Australian company that are providing services to the government of Portugal. One of the companies is withdrawing from the contractual arrangement and the one of the other companies is taking over its responsibilities in the contract. In the Portuguese translation this is rendered as "Acordo de Cessão de Posição Contratual." Is this the best way to translate "Deed of Novation" for Portugal? Is there a more concise way to say it? It seems a little cumbersome. Does anyone have any ideas? Many thanks in advance.
Explanation: If cessao can mean surrender - my Port. lang. or law isn't up to it - then all well and good. But novation isn't the same as assignment. It's a new party substituted, usally for the debtor.
