Reclamanta a declarat apel critiând modul eronat în care instanţa de fond a reţinut situaţia de fapt ce a condus la pronunţarea soluţiei atacate, susţinând că erau îndeplinite condiţiile art.399-405 C.proc.civ., întrucât vânzarea unui imobil pentru o creanţă care nu este certă, lichidă şi exigibilă, constituie o cauză de vătămare prin executare; că prin sentinţa civilă nr.1941/1995, a Tribunalului Bucureşti, investită cu formulă executorie, instanţa nu a hotărât vânzarea imobilului ci a dispus plata sumei de 190.301 de lei, deşi contractul de credit nr.1139 din 12 noiembrie 1992 a fost prescris la 12 noiembrie 1995 iar comandamentul din 26 februarie 1999 nu a fost instituit în baza sentinţei civile nr.1941/1995 ci în baza încheierii din 3 februarie 1999 considerată act de creanţă, astfel că atât dreptul la acţiune cât şi dreptul de a cere executarea silită, au fost prescrise.

a prescrie: refl. pas (despre pedepse penale, drepturi de proprietate, etc) A se stinge, a inceta prin prescriptie. 2. a-si pierde valabilitatea.

prescriptie: dispozitie legala in virtutea careia, dupa un anumit timp si i anumite conditii, se castiga ori se pierde un drept sau inceteaza efectele unei hotarari judecatoresti.
