Откуда ноги растут: Письменные показания обычно являются первым шагом, а показания в суде - вторым. В письменном показании свидетель как бы говорит: Я Иван Иванов _буду давать_ следующие показания в суде под присягой. Но реально этот смысл уже давно отпал, т.к. точно также составляются свидетельские показания тех свидетелей, которые в суде выступать не собираются (e.g. witness deposition).

A will-say statement is the summation of what a witness will testify to in court. Will-say statements are also referred to as witness statements. Both the defense and the prosecution have access to will-say statements to help prepare for the hearing. A will-say statement is often prepared by the witness herself or an attorney, but the attorney must present the events as the witness is describing them. Will-say statements must be an accurate reflection of what the witness will testify to and comply with court rules.

Может быть, форма и устарела, но я бы все-таки оставил будущее время.
"will-say statement" подготавливается заранее перед судебным процессом и предоставляется защите и обвинению, чтобы у них была информация, о чем свидетель собирается заявить.
