The function of a child placing agency may also include the supervision of children who are 16 or 17 years of age and who are living in unlicensed residences as provided in section 5(4).

Данный вариант, к сожалению, не совсем подходит для данного контекста.
1. Как правильно отмечено, данному агентству дано право "receive children for placement in foster homes", но как тогда быть с "capacity - not applicable"? В других штатах в лицензиях в графе "capacity" указывается возраст детей и тогда "capacity" уже будет выступать в другом многозначном качестве.
2. Лицензирующий орган штата Мичиган выдает лицензии не только агентствам по усыновлению, но и другим организациям, заведениям, барам, дискотекам, залам и т.д., а следовательно, "capacity" в данном случае относится именно к ним, являясь "not applicable" для агенства по размещению детей.
2. Вот одно из предложенных мне толкований: "...they may also be into licensing, say, bars and performance venues (auditoriums, etc.).", что подтверждало мои догадки.
3. Вполне вероятно, что "пропускная способность" может подойти в каком-то из случаев. М.б. и "наполняемость", но все зависит от контекста.
4. С учетом замечания Василия Барышева и других я написал: "Количество мест(для предприятий общ. питания и др. заведений.)" Согласен, "общественное питание" отдает коммуной, но что поделать...

Статья 49. Правоспособность юридического лица

1. Юридическое лицо может иметь гражданские права, соответствующие целям деятельности, предусмотренным в его учредительных документах, и нести связанные с этой деятельностью обязанности.

Коммерческие организации, за исключением унитарных предприятий и иных видов организаций, предусмотренных законом, могут иметь гражданские права и нести гражданские обязанности, необходимые для осуществления любых видов деятельности, не запрещенных законом.

Отдельными видами деятельности, перечень которых определяется законом, юридическое лицо может заниматься только на основании специального разрешения (лицензии).

2. Юридическое лицо может быть ограничено в правах лишь в случаях и в порядке, предусмотренных законом. Решение об ограничении прав может быть обжаловано юридическим лицом в суд.

3. Правоспособность юридического лица возникает в момент его создания (пункт 2 статьи 51) и прекращается в момент завершения его ликвидации (пункт 8 статьи 63).

Право юридического лица осуществлять деятельность, на занятие которой необходимо получение лицензии, возникает с момента получения такой лицензии или в указанный в ней срок и прекращается по истечении срока ее действия, если иное не установлено законом или иными правовыми актами.
