I would like to know what will be the best way to translate this phrase from American English into Latin American Spanish.

It's the translation of a legal document from The New York State Courts.

Here is the full phrase:

Usage
Depending upon local custom, legatees may be called "devisees." Traditionally, "legatees" took personal property under will and "devisees" took land under will. Brooker v. Brooker, (Tex. Civ.App., 76 S.W.2d 180, 183) asserts that "devisee" may refer to "those who take under will without any distinction between realty and personalty...though commonly it refers to one who takes personal property under a will."

DIFERENCIAS:
1. El heredero lo es siempre a titulo universal. El legatario lo es a título particular.
2. El heredero tiene responsabilidad ilimitada en cuanto a los efectos jurídicos derivados de la herencia. El legatario no responde de esos efectos.
3. El heredero continua la personalidad jurídica del causante ya que tiene una sucesión in iuris. El legatario no se coloca en la posición jurídica del difunto ya que carece de una sucesión in iuris.
4. La herencia se hace depender del título de heredero. El legado es una trasmisión patrimonial pura y directa.
5. El heredero adquiere la posición conforme al art. 995 del C.C pero sin necesidad de toma de posesión material. El legatario al contrario debe pedir necesariamente al gravado la posesión de la cosa legada.


SEMEJANZAS:

1. Ambas son disposiciones por causa de muerte.
2. Ambas pueden o no coincidir en un testamento.
