Mi diccionario jurídico (Derecho australiano) dice lo siguiente:



Survival of actions

The continued existence of a cause of action despite the death of the person it was vested in. At common law, all causes of action for personal injury died with the person in whom they were vested (actio personalis moritur cum persona). State legislation provides that, on the death of a person, certain causes of action subsisting against or vested in him or her survive for the benefit of or against the deceased’s estate: (NSW) Law Reform (Miscellaneous Provisions) Act 1944 s 2(1); (QLD) Succession Act 1981 s 66(1); (VIC) Administration and Probate Act 1958 s 29(1). Thus, a living victim may sue the estate of the tortfeasor or an action can be brought on behalf of the victim’s estate. However, legislation expressly excludes the survival of any claim for defamation or seduction, exemplary damages or damages for pain and suffering: (NSW) Law Reform (Miscellaneous Provisions) Act 1944 s 2(2); (QLD) Succession Act 1981 s 66(2); (VIC) Administration and Probate Act 1958 s 29(2).


La nota de Idoiaea no me parece acertada porque los "torts" no tienen que ver con el Derecho Penal, así que no cabe hablar de acusado. Estas son causas en lo civil.

se adaptaría porque no indica si la acción fue o no comenzada por el difunto... (porque habrá otras reglas para ello) sino simplemente indica que hay acciones que a causa de la intervención del legislador puede iniciarse una causa, cosa que en common law no era posible

En realidad "póstumas" lo utilizaría para los casos en que la acción se iniciare después del fallecimiento; "sobrevivientes" para aquellas acciones ya iniciadas y que continuaren luego del fallecimiento.

agree  Tomás Cano Binder, BA, CT: A mi entender "cláusulas sobrevivientes", porque no creo que sea por la supervivencia de los contratantes, sino que esas cláusulas siguen vigentes tras la expiración del contrato.
