agree  Sandro Tomasi: Has optado por terminos genericos --fallo, competente-- en lugar de "pena" y "sentenciador", respectivamente. Es importante saber que el juez debe decidir la "pena" por imponer. Esa decision es una "condena", que forma parte de la sentencia condenatoria.
