Deduzco que se trata de una errata y que debería decir "merchantability" (con "t").

"Merchantability" significa "marketability, ability to be sold or marketed, quality of being saleble".

Por lo tanto, propongo:
"Toda garantía de comerciabilidad..." (77 resultados en Google). Si el palabro no te gusta puedes optar por "capacidad de comercio", aunque esta expresión no se utiliza.

Como siempre, el lenguaje jurídico es enrevesado y difuso, razón por la cual los abogados cada día ganan + $$$$$. Aquí creo que lo importante, es no ya traducir la palabra en sí -comerciabilidad, un palabro- que es obvio, sino traducir el concepto y el verdadero significado. En este sentido, el significado es: la garantía de que un producto es comercializable, es vendible; en definitiva que es apto para su consumo o venta atendiendo a las normativas vigentes, reglamentos y normas (seguridad, sanidad,OSHA, FDA, FDC, etc). Esta es una cláusula de LIMITACION DE RESPONSABILIDAD. Así, esta cláusula prentende eludir por parte del fabricante sus responsabilidades en el caso de que el producto no fuera apto para el consumo o su venta, hasta el límite del precio pagado por el producto. Lo cual por otra parte es un abuso, como en el caso de los productos de software, incluyendo a Microsoft.
