Se configuran dentro del Derecho a morir dignamente. Se trata de aquellas instrucciones que una persona afectada por un padecimiento agudo o crónico gravemente incapacitante o terminal (como cáncer, sida, insuficiencia renal o hepática terminales, etc.)tiene derecho a dar antes de morir (a manera de última voluntad) para que no se hagan esfuerzos excesivos por prolongarle la vida por medios artificiales cuando las expectativas de recuperación son inexistentes.

En efecto, se trata de disposiciones de última voluntad. Considero más adecuados los adjetivos ¨anticipadas¨ o ¨provisorias¨ por ser más idiomáticos en nuestra jerga jurídica, que no ha de ser calco del inglés.

Living Will es una redundancia en nuestro idioma y debemos traducirlo como testamento activo, es decir, en plenas facultades, sin merma alguna de las mismas por enfermedad. Es obvio que no se puede testar póstumamente, por lo menos hoy en día.
