Sugiero la palabra 'progenitor', 'progenitora'para no tener que estar cambiando entre padre y madre. No veo la necesidad de poner 'encargado/a' sino solo la palabra con (custodia).

"Patria potestad" y "custodia" son cosas diversas.
Ahora, en el castellano que conozco se emplea la expresiôn "guarda y custodia", no solo "custodia".
Lo de padre/progenitor, madre/progenitora es pefectamente intercambiable...
Sería, pues, "con guarda y custodia" y "sin guarda y custodia"...
