Translating a historical record of jurisprudence/legal opinion (circa 1908). Paragraph is as follows:

Il nous semble que cette affirmation est exagérée. L'absence de la mention "sur offres fermes" ne prouve pas absolument qu'il soit interdit au commissionnaire de se constituer contre-partiste. Rien n'empêche le commettant de l'autoriser à procéder ainsi, même dans le cas où il le charge d'opérer au mieux de ses intérêts. Sans doute, il est très imprudent de donner de pareils ordres (sur le danger de la taille dans le cours que pourrait pratiquer l'intermédiaire, V. notre note sous Req. 28 mars 1904, D.P. 1905. 1. 65).
