From what I have been able to find, a "jour de souffrance" (also called "jour de tolérance") is not a 'servitude', but a simple 'tolérance'.
I'm wondering if the text could be referring to the possiblity of the owner of these "jours" to purchase a "titre de servitude" from the entity/person about to block the openings with the new construction, effectively transforming this "tolérance" into a "servitude de vue". The "titre de servitude" would impose regulatory distances for any new construction as laid out by articles 678 and679 of the French Civil Code.

• Une servitude de vue s’acquière par acte notarié entre les propriétaires des parcelles concernées. Elle est imprescriptible.

• L’ouverture établie en infraction à la règle peut être acquise par prescription, si elle constitue une servitude de vue (et non un jour de souffrance).

• (2) Il appartient aux juges du fond d’apprécier le caractère des ouvertures autorisées, selon la nature des matériaux (verre translucide, briques de verre…) et l’atteinte, portée ou non, aux droits du voisin.

something like; the ofiices get refurbished and payments are made to "buy out" rights to light? e.g. the office development potentially interferes with a neighbouring property's right of light so a payment is made in compensation for extiguishing it, i.e. abolishing the servitude (easement)
