Contract of a tour operator of some kind:

(article: "Annulation totale de l'Evènement par Prestataire", last sentence:)

"Dans le cas où l'annulation serait causée par un cas de force majeure tel que définie à l'article 17, la garantie et la responsabilité du Prestataire ne sauraient être recherchées et retenues."

NB there is no mention of the word "garantie" in this article. However the Prestataire's "financial guarantee" is mentioned earlier : "Sa garantie financière est souscrite auprès de XXX pour un montant de YYY euros."

(article: "Force Majeure", opening sentence:)
"Dans le cadre de l’exécution des prestations au titre du présent Contrat, la garantie et la responsabilité du Prestataire ne sauraient être recherchées et retenues si le retard, le non-respect de l’une de ses obligations, ou la non-exécution de la prestation résulte d’un cas ou d’une situation de Force Majeure."

retenir la responsabilité de X = "hold X liable"

rechercher la responsabilité de X = stronger, it seems to me, more like "take legal action against X"

Conversely, I'm not entirely convinced that "rechercher la garantie de X" or "retenir la garantie de X" really work. It appears that the author may mean "invoke the benefit of X's guarantee".

Above all, how to shoehorn both "garantie" and "responsabilité", combined with both "rechercher " and "retenir", into a suitable sentence?

I note in particular the concordance de nombre: "recherchées" and "retenues". For me this implies that the author does in fact consciously believe a "garantie" can be "recherchée" and/or "retenue".
