neutral  writeaway: since you don't provide a ref, should I assume you borrowed this from the one I posted?

neutral  Germaine: "its own" costs as mentioned in the reference posted by writeaway.

disagree  Daryo: the subject of "Compense les dépens de l'instance" is "Le tribunal" => so the Court is ordering itself to pay for its own costs???

Apportion the costs of the proceedings (equitably)

Explanation:
The Court shall apportion the costs of the proceedings between the parties.

"Discretion over costs. The court may apportion the costs of the proceedings as it deems equitable".

"Proceedings, conduct of—Costs.
The proceedings shall be conducted as other civil actions, and the court, on final decree, shall apportion the costs of the proceedings equitably ..."

Notes to answerer
Asker: Thanks. But as this is a final ruling, does it not need to specify exactly how the costs are shared? Is it clear that it means 50/50?

-> Thank you. Yes, it is used as an example.

neutral  Germaine: c'est "compenser" dans le sens de "offset": chacun paie ses frais.
18 hrs

disagree  Daryo: the intuitive meaning of "compenser" (and more importantly refs) would imply "each party pays its own costs" NOT that all costs are pooled together and then spit - as you interpreted it // If one party used more a expensive lawyer, it's their problem!
