The adjectives are almost defined by the following nouns; i.e., confiscation is mandatory, hence the crime is "subject to" it; yet when confiscation is optional, the crime is only "eligible for" it. I don't quite see, however, how they fit into the same sentence, as the two punishments seem to be dealing with the same crime.
