Arbitration procedings where the Claimant is claiming she was wrongfully dismissed. The company statutes set out the rules for how a partner in the firm can be dismissed. The claimant alleges that she did not commit any fault worthy of dismissal.

Comme indiqué supra la Cour de Cassaion reconnait la validité de telles clauses, pour permettre de sanctionner une faute grave. Encore faut-il, pour la doctrine suivie en cela par la jurisprudence que soient énoncés dans les statuts les motifs d'exclusion, suffisamment précis et inspirés par l'intéret de la société, pour éviter qu'elles ne servent à écarter un associé simplement genant.
