If I understand this correctly, a party may ask a court to order that evidence be assembled (in this case by appointing an expert witness) or safeguarded (perhaps against destruction), if it can provide credible evidence that litigation will take place at some future date.

Mesure might be better circumscribed as relief, like an order for disclosure, rather than a 'step taken (suually by one party) in the proceedings' (acte de procédure).

I'm sure there's a similiar test in ENG law for an injunction e.g. the likelihood of a successful round of litigation and a 'realistic prospect of success'.
