Ich glaube schon, dass dieses "il" sich auf "le principe" bezieht.

"Dieses Prinzip schließt aus, dass..."

Den Rest verstehe ich auch so wie du. Dem "Täter" kann nichts vorgeworfen werden, wenn er zum Zeitpunkt der "Tat" nicht wusste, dass seine Tat rechtswidrig war, auch wenn das Gesetz eindeutig ist, da er auch nicht wusste in welchem Rahmen er sich gerade befand.
