French to English translations [PRO]
Law/Patents - Finance (general)
French term or phrase: avec déchéance
A settlement between a creditor and a debtor:

I'm not sure I understand the last fragment: "avec déchéance de l’ensemble des termes convenus"

neutral  Daryo: it's not about the initial T&C

agree  ph-b: I think it's only about the repayment terms, not about all the T&Cs. However, you might be right: they do say engagements pris aux termes (du contrat] and then say that l'ensemble des termes convenus are cancelled. But how would that work?
3 hrs
-> Maybe all terms and conditions are deemed cancelled and the debtor loses all of his rights; but that's suggesting that the creditor also does so! Could be simply bad drafting, it won't be the first time!

with the invalidation of all of the agreed terms

Explanation:

this about an agreement for rescheduling the repayment of some [most likely overdue] debts.

what this says is that if any payment is missed, all the "termes convenus" regarding the delayed repayment of the debt will no longer be valid / no longer in force, and the obligation to repay will revert to the initial schedule / agreement.

There might be a better term than "invalidation", but I'm sure about the explanation.

neutral  ph-b: It isn't about repayment dates having been rescheduled. If the borrower doesn't repay according to the originally scheduled dates, he'll have to pay the whole of the balance due on the missed date immediately.

-> in fact, it could be both // Asker has [should have] the whole contract, so should know which one it is.

avec déchéance des termes convenus
cancellation of the agreed loan repayment schedule

Explanation:

"Any non repayment will cancel the agreed loan repayment schedule".

I think this is what it means and I'll leave it to native speakers of English to rephrase the translation.

Déchéance du terme according to Université numérique juridique francophone:

You'll find quite a few 'real life' examples on the 'Net, among which:

I realize that the info above is about terme in the sing. but a) I can't find many relevant, contemporary examples of déchéance des termes and b) this example appears to show that in the plural, termes (i.e. due dates) can refer to créances, which is applicable in your case:
