Hi All

I know this is a simple one but I am looking for confirmation. At the end of a marriage certificate, on the husband's side, it states:
- that he is the son of Mr X and Miss Y, son epouse.

It then goes on to say:

Contract de mariage: Il n'a pas ete fait de contract de mariage

I am to assuming that his parents were not married? then why 'son epouse' - am I just going mad?

Explanation:
I wonder if it refers to the fact that they were husband and wife under local rules and customs, but had not gone through the civil marriage. Perhaps they were married in a church but had not celebrated the official civil marriage.

Explanation:
In some countries when two people live together and have children and pretty much live like a marriage but without a contract or a licence they are considered like a marriage "in fact" or something like that, I don't know maybe that is what it means, they treat them as spouses even though they are not legally married...

Good choice in my opinion. The existence, the "making" on the ontrcat is what is important here. Whilst it is true that "execute" (or indeed "drawn up") sound more legal, it would the emphasis on the signing of the agreement rather than on the fact that it exists.

FYI, in France, if a couple does not have a marriage contract, then basically, if things go wrong, it's 50/50 no questions asked, in spite of what each party brought before marrying and built in terms of assets/liabilities during the marriage. In the case of France, I would avoid using "pre-nuptial" agreement as a contract can be drawn up at any time.
