French term or phrase: incident de mise en état
In a court case, X "provoqué un incident de mise en état pour voir le juge de la mise en état statuer sur sa compétence territoriale". I'm afraid I have no further context as this is a sentence set out on its own in the summary of facts. Is there a set phrase for this in English? Any suggestions gratefully received :-)

I don't think there is an exact equivalent as French law is rather different from British/US law.

A "procédure de mise en état" is the same as "pre-trial procedure".

Here, I think it means someone provoked a pre-trial procedural incident so that the judge would have to rule on jurisdiction.

juge de la mise en état = juge chargé de l'information et du suivi de la procédure" = PROCEDURAL JUDGE


Définition de Mise en état

La "mise en état" est la phase de la procédure écrite, au cours de laquelle se déroule l'instruction de la cause sous le contrôle et la direction d'un Magistrat du siège appelé, devant le Tribunal de grande instance, le "juge de la mise en état" et devant la Cour d'appel, "le Conseiller de la mise en état".

Sauf devant les Chambres sociales des Cours d'appel où la procédure est orale, pendant cette phase de la procédure, chacune des parties, est représentées obligatoirement en première instance par un avocat et devant la juridiction du second degré par un avoué. .

Il n'y a pas de Magistrat désigné pour la mise en état devant la Cour de Cassation c'est le service du Greffe de la Cour qui se charge de mettre la cause en l'état. Il n'existe pas non plus de mise en état ni, devant le Tribunal d'instance ni, devant les juridictions spécialisées devant lesquelles la procédure est orale.



Le juge de la mise en état est un magistrat du tribunal de grande instance chargé de veiller au bon déroulement du procès civil (litige entre particuliers).

Une affaire ne sera en effet jugée que si elle est "en état", c'est-à-dire si le dossier est complet et que les adversaires se sont communiqué mutuellement leurs arguments ainsi que leurs preuves.
Le juge de la mise en état est désigné pour surveiller l'instruction d'un procès civil complexe.

Not idication of whether a civil or criminal case, but an abs. crucial distinction in the UK for terminology.

Une incident d'instance generally is an interlocutory application - Ian Dhu is right as it is at the pre-trial stage - that can hold up or put an end to i.e. dispose of the action.

A 'for mention' hearing is an administrative hearing in a criminal case. On a PDH: pleas and directions hearing in the UK, the charges are put to the accused. Here it does not seem to be the case, but a taking of plea to jurisdiction.
