“pure and simple regime of property separation” or “regime of pure and simple separation of property Explanation: “pure and simple regime of property separation” or “regime of pure and simple separation of property" The following excerpt is bilingual. It uses the phrase in English, followed by a French citation whose title uses the equivalent French phrase: http://www.lexum.umontreal.ca/csc-scc/en/pub/1990/vol2/texte... “The wording of the article is very broad and in practice it allows the judge to extinguish completely the regime of separation of property chosen by the spouses (see André Cossette, "Le régime de la séparation de biens est-il disparu avec la naissance de la prestation compensatoire?" (1985), 87 R. du N. 456).” The same essay uses the English expression “regime of separation of property” many times. Here are a few samples: “The parties were married in 1969 under the regime of separation of property and ceased all cohabitation in 1977. “ “The parties were married in 1969 under the regime of separation of property. After a brief separation followed by a reconciliation in 1971, they finally ceased all cohabitation in 1977.” “Quebec law has long recognized the freedom of matrimonial agreements and the right of spouses to opt for the regime of separation of property.” Here is another article using the expression: http://www3.sympatico.ca/goldwaterdube/bankruptcy.pdf “The spouses were married under the regime of separation as to property, and the matrimonial home was registered in the husband’s name.” I hope these are sufficient to establish the usage of this expression in English. Nature of marriage settlement : pure and simple separation of property Explanation: Nature of marriage settlement : pure and simple separation of property. The provisions which separate each partner's property apply to the property of each before and during the mariage (cf. art 1536 below). And on the GDT where you will find a series of succinct definitions and one or two translations of the term. Take your pick from : - separation of property - separation of estate The following also appears and may be a useful base to adapt for your term : droit 3 / 6 separation as to property séparation de biens n. f. droit 4 / 6 separate estates by antenuptial settlement séparation de biens n. f. [1978] EURODICAUTOM gives « matrimonial property law » for “regime des biens” (matrimoniaux). Reference: http://www.legifrance.gouv.fr www.granddictionnaire.com ; EuroDicAutom |
