French term or phrase: contrats aléatoires
We are still on 'contrats de viager', which the writer says are considered as 'contrats aléatoires' as defined in Article XXX of the French Civil Code, and which depend on an uncertain event. I have put "agreements with an uncertain element" but am not too happy with this. Any ideas?

Termium has this French term, and the equivalent English common law term. Since this is specifically identified as being *common law*, I think you are quite safe in using it.

Yes. An aleatory contract is one in which a party's duty of performance depends upon some uncertain event : Ellesmere v Wallace [1929] 2 CH 1 (in this case it was a wagering contract, not exactly the same context). Dixit Dic of Law, Curzon 5th ed., Financial Times Publishing

Sinon, un "contrat aléatoire" est "un contrat à titre onéreux dans lequel l'existence ou la valeur d'une présentation dépend d'un événement futur incertain. (Ex. contrat de rente viagère). Dixit Lexique de termes juridiques 9° ed. DALLOZ. (The bible for law students, at least first & second year here and in Aix-en-Provence).

No doubt in my mind that the terms mean the same thing.
