Explanation:
This is assuming that your text has a typo, and that the phrase is actually "d'heure en heure" (corroborated by both Larousse and Harrap's).

It's unlikely that proper legal French would say "à heure" -- grammatically it would have to be "à l'heure"!

To the best of my knowledge, the "heure" phrase, in whatever form, has no specific meaning or English equivalent in legal usage.

However, proper legal French does say "en réferé." This phrase refers to a judge's chambers, as opposed to open court. For instance, "juger en réferé" means to try a case in chambers; an "ordonnance de réferé" is an order or injunction issued in chambers; and an "audition en réferé" is the ever-popular hearing in chambers.

In your case, "assigner en réferé" most likely refers to the issuance of a summons, subpoena, or notice to appear in chambers, possibly at a time to be determined, or else on a sort of stand-by basis.

There is no mistake in the original, bar the « assigné EN référé » and it is « d’heure A heure ». When you enter both terms plus the word « procédure » and so a search on GOOGLE.COM for example, many of the hits refer to cases where the complainant has applied to the court for an emergency injunction , as it were, an injunction being a court order addressed to a particular person or company that either
- prohibits him/it from doing something , or
- - from continuing something
These are known as « prohibitory injunctions »
Injunctions can also order a person to carry out a certain act (mandatory injunction).
An injunction which is needed urgently, . a temporary injunction, known as an « interlocutory injunction » can be granted at a special hearing pending the outcome of the main case. In later proceedings, damages are often sought by the complainant and a « perpetual injunction » may be granted . If the party then refuses to respect the terms of the injunction, he is in contempt of court.

The case in point is a classic example of an interlocutory injunction being granted in order to prevent something from being done
