French term or phrase:branche du moyen
Pleadings in a case in which a tanker damaged port facilities in a berthing (or docking?) manoeuvre.
One section is headed "Sur la première branche du moyen". Eurodicautom gives "limb of a plea". Can anyone confirm that this is correct?
I actually typed a long msg here but for some reason it did not appear. Here goes again:
the first "branche du moyen" argues that the Court of Appeal breached two articles of the New Code of Civil Procedure. The second says that the decision appealed against is vitiated by the lack of a clear legal basis and the third that the decision denied the defendants the benefit of the limitation of liability provided for by the London Convention on Maritime Claims.
