L'ACA a fortement critiqué cette disposition dans la mesure où elle s'applique également au courtier. En effet, le courtier est le manataire du client et l'assureur n'est pas en mesure de contrôler et de choisir le courtier avec lequel il travaille. Le client désigne ligrement son courtier; poruqoui l'assureur devrait-il **pâtir (au risque d'être lui-même confronté à des difficultés financières)** de la malhonneteté d'un intermédiaire sur lequel il ne dispose d'aucune main mise?

Mir ist hier die Argumentation (einschließlich des Satzes in Klammern) nicht klar.

hier heißt das: dass die Versicherungsgesellschaft ihre Agenten nicht selbst aussuchen kann, da ja das der Kunde= Versicherungsnehmer selbst tut,wenn er zu einem Versicherungsmakler geht. Und wenn die Versicherung hier schon keinen Einfluss auf die Wahl des Maklers hat, dann sollte sie auch NICHT DAS UNLEID/ NACHTEILE HIERAUS TRAGEN.

(speziell finanzieller Art, wenn schon mal einer der Versicherungsmakler seine Türen schließt und auf einmal verschwindet, was doch ab und dann vorkommt).

... warum sollte der Versicherer unter der Unredlichkeit eines Dritten leiden, auf den er keinerlei (main mise???) hat - und möglicherweise einen finanziellen Schaden davon tragen.

Kannst Du noch daran feilen - main mise steht bestimmt im Potonnier...
