Le matériel est livré directement par le fournisseur et réceptionné par le locataire, sans que la responsabilité du bailleur puisse être engagée à quelque titre que ce soit, et notamment en cas de livraison incomplète ou tardive ou pour tout dommage quelconque intervenu lors du transport, de la réception, de l'utilisation du matériel, pour tout dommage causé au tiers etc.... Le matériel est livré aux frais et risques du locataire et sous sa responsabilité.
En toute hypothèse, en sa qualité de mandataire du bailleur, le locataire exécute, à ses frais, l’obligation de retirement du matériel.
