The EEC Block Exemption for Franchise Agreements in effect since February 1, 1989, was generally acknowledged as a guideline for the design of franchise agreements. This also applied for the definitions regarding the concept of franchising, franchise agreements or the know-how which concretizes a franchise agreement. This block exemption is substituted by the EEC Block Exemption for Vertical Restraints, so that henceforth franchising does no longer receive a special treatment by individual exemption, but will be integrated in the block exemption for all kinds of vertical restraints, though the new Block Exemption for Vertical Restraints has caused uncertainties whether the European Commission considers franchising as a separate form of distribution or merely as a subdivision of selective distribution.
