das vom Auftraggeber zu zahlende Gesamtentgelt

German to English Tech/Engineering Computers: Software Software support contract
Einmal im Jahr werden die Vertragspartner das Wartungsentgelt auf der Basis der dann aktuellen Herstellerpreise und der in dieser Vereinbarung festgelegten Entgeltsätze das vom Auftraggeber zu zahlende Gesamtentgelt entsprechend dem wartungsrelevanten Investitionsvolumen einvernehmlich neu festlegen.

I am basically confused by the whole sentence and cannot see where this nit fits it (das vom Auftraggeber zu zahlende Gesamtentgelt). Could someone break down the sentence for me so it makes sense?

Agree with Armorel, but IMO you should ask the client for clarification. The sentence is evidently misworded, and guessing is not advisable when translating contracts.

I agree that as it stands this makes no sense - but it would make sense if "und" were inserted before "das vom Auftraggeber.." (so that there are 2 things being settled.

Proposed translations

das vom Auftraggeber zu zahlende Gesamtentgelt entsprechend dem wartungsrelevanten Investitionsvolumen einvernehmlich neu festlegen.
. . . shall determine in consultation with one another the total fee to be paid by the awarder of the contract on the basis of the amount of investment required for maintenance.

I have translated this part for you. You should be able to do the rest.

This is how your phrase should fit in with the rest.

Thanks, so why the Wartungsentgelt at the beginning of the sentence and then Gesamtentgelt again here? I just can't see it...

I think you are right in being confused, and I would assume that there is an "und" missing after "Entgeltsätze". My version would then come out as :

"Once a year, the contractual partners will mutually agree on a service fee [charge] based on current manufacturers prices and the rates defined in this agreement and a total fee [charge] (to be paid by the contracting party) with respect to the volume of investment requiring servicing".

I would definitely get the customer to check the wording though, there is definitely something missing.
