I've always been unhappy with the "official"=dictionary translation: rights equivalent to real property or some such construction ;-)

Given Creifeld's definition -- "... ist ein dingliches Recht (-> Sachenrecht), das rechtlich wie ein Grundstueck behandelt wird" -- would *chattel right* be a viable alternative or would that exclude such rights as "Erbbaurecht," for instance?

Many thanks in advance for your help, esp. with regard to the meaning of the German term!

My brand-spanking-new BLD (;-) - I've always only had the pocket version) defines chattel real as "a real-property interest that is less that a freehold or fee, such as a leasehold estate. The most important chattel real is an estate for years in land, which is considered a chattel because it lacks the indefiniteness of time essential to real property. - Also termed real chattel."

I see where you are coming from with "chattel right", and it may be more fitting, but I wonder if "chattel real" might work. Creifeld's definition for "grundstücksgleiches Recht" makes me think, "No sh*t Sherlock!" But in looking at Creifeld definition of "Erbbaurecht", I can't help but see a similarity with the definition of chattel real: "[...] Mit dem Erlöschen des Erbbaurechts - regelmäßig mit Ablauf der vereinbarten Dauer - geht das Eigentum an dem errichteten Bauwerk automatisch auf den Grundstückseigentümer über [...]".

Sorry, the definition should read \"...less than a freehold...\". ;-)

agree Adrian MM. (X) : chattel real = leasehold and covered by Erbbaurecht. An exceptional hybrid in Eng. land law as partakes of both a chattel/ personalty (NB spelling) and land/ realty. Hence, in Wills, 'I leave, devise and bequeath' to catch the blighter.
