It's the context that has me a bit confused with this. In talking about replacing any of the provisions of a contract that are deemed invalid with ones that come as close as possible to the meaning and intent of the originals, the word "wirtschaftlich" appears. The full sentence reads: "Insofern verpflichten sich die Parteien, eine der unwirksamen Bestimmung (wirtschaflich) möglichst nahekommende Neuabrede zu treffen."
