This is a legal interpretation of a Swiss law of obligations provision. I have found "subject to be contracted away" and "transactionable" for abdingbar in Romain and "not mandatory" and "modifiable" in Hamblock/Wessels.

Denn mit der Abdingung einer bestimmten Preisgefahr erklärt der Besteller nicht, er wolle das Werk fortführen, wenn es wesentlich teurer zu stehen kommt.

Anzeige der kostenverteuernden Umstände bildet eine Voraussetzung des Preisbesserungsanspruch des Festpreisunternehmers. Wer eine Vertragsänderung will, muss es erklären, sobald die anspruchsbegründenden Voraussetzungen eingetreten sind. Stellt er nicht die mit der Anzeige verbundene Vertragsänderungsofferte, so ist anzunehmen, er verzichte darauf und halte sich an die Festpreisvereinbarung. Er bestätigt die bestehende Festpreisvereinbarung durch stillschweigende Genehmigung. Art. 370 N. 1-3. Selbst den Eintritt von Kostenverteuerungen, welche nach ausdrücklicher lex contractus nicht zu Lasten des Festpreisunternehmers gehen, muss dieser anzeigen. *Denn mit der Abdingung einer bestimmten Preisgefahr erklärt der Besteller nicht, er wolle das Werk fortführen, wenn es wesentlich teurer zu stehen kommt.*

IOW, if you submit an offer to build a house for me and I "waive the price risk", it doesn't automatically constitute a declaration on my part that I want you to build it even if it costs twice as much as the fixed price specified in your original offer.
