Law/Patents - Law (general) / Swiss law of obligations/contract for work
German term or phrase: Abdingung einer Preisgefahr
This is a legal interpretation of a Swiss law of obligations provision. I have found "subject to be contracted away" and "transactionable" for abdingbar in Romain and "not mandatory" and "modifiable" in Hamblock/Wessels.

"Abdingung" almost certainly means "waiver".

Although "Preisgefahr" generally means "Gegeleistungsgefahr"

(www.unifr.ch/zrhr/documents/lehre/examen/Saetze OR AT mit H...

http://de.wikipedia.org/wiki/Gegenleistungsgefahr),

in your case it really does appear to refer to an actual increase in price for the offered service.

So maybe "waiver of price risk" (or, to use Jonathan's term, "waiver of price variation risk", although it almost certainly refers to an "increase" rather than a "variation").

IOW, if you submit an offer to build a house for me and I "waive the price risk", it doesn't automatically constitute a declaration on my part that I want you to build it even if it costs twice as much as the fixed price specified in your original offer.

And, of course, you have the "bestimmt" in there to additionally qualify the phrase.

Thank you, Tony. This was very helpful. In some cases - in other passages - exclusion also seemed to work for Abdingung.
