Tatbestand as used in Grundtatbestand means \"elements\" as in the elements of a case.
Alone, it means \"the facts of the case\' or the \"factual situation.\"
Each crime is defined by certain elements thereof which must have taken place or occurred. If there are 4 elements to a crime and only 3 have taken place, the crime has not taken place.
Here, one element in making a decision or determination is default or non-payment, so you may use my first suggestion above, but if you would be more comfortable with the second, be my guest.

agree Beate Lutzebaeck : I'd go with occurrence of default (non-payment), since Tatbestand is used in a more general context here (insurance), rather than in a criminal law context. Literally: when all the conditions/prerequisites have been met that constitute default in payment.
