I've seen it in Swiss legal documents
agree Steffen Walter : Mary, I think the author mixed up "sich (mit jemandem) ins Benehmen setzen" (the meaning of which would be along Kim's lines) and "im Ermessen der... Partei" (at the discretion), the latter is the "mot juste" in this context.

One meaning of Benehmen is "Verbindung aufnehmen" - Wahrig. "Sich ins Benehmen setzen mit jdm." is to consult with according to Hamblock/Wessels
