2.2. Kündigung gemäß § 649 BGB

Die Ausführungen der Beklagten zu einer Kündigung der Klägerin gemäß § 649 BGB sind unerheblich, da die Klägerin nicht die ***freie Kündigung*** gemäß § 649 BGB erklärt hat.

In dem Schreiben vom 09.11.2011 (Anlage K 35) hat die Klägerin ausdrücklich nur den Rücktritt vom Vertrag (Anlage K 7), die Kündigung aus wichtigem Grund und die Anfechtung wegen arglistiger Täuschung erklärt. Darüber hinaus hat sich die Klägerin ausdrücklich die Geltendmachung weiterer Gründe für eine Vertragsbeendigung (z.B. die Kündigung gemäß § 649 BGB) vorbehalten. Ferner hat die Klägerin auch mit Schreiben vom 01.12.2011 (Anlage K 37) noch einmal ausdrücklich klargestellt, dass sie die Kündigung gemäß § 649 BGB nicht erklärt hat. Eine Kündigung des Vertrages gemäß § 649 BGB ist damit nicht erfolgt.
