czy ktoś wie, jak to się nazywa?

Hielte man ein gespaltenes Rechtswidrigkeitsurteil trotz alledem für ausgeschlossen, so wäre statt der dann nicht mehr möglichen Teil-Rechtfertigung zumindest ein Strafunrechtsausschluss anzunehmen, der die strafrechtlichen Wirkungen von § 32 im Ergebnis in gleicher Weise bestehen ließe; durch eine entsprechende zivilrechtliche Konstruktion wäre der Beamte im Falle eines Schadensersatzes nach § 839 Abs. 1 BGB iVm. Art. 34 GG von einem Rückgriff nach Art. 34 Abs. 2 GG freizustellen.
