It's a cost distribution (proration) scheme that prorates the costs and sets the share to be paid by each of the tenants. The phrase "nach billigem Ermessen festzulegenden Verteilerschluessel" means that the distribution of costs is to be done on the basis of the distribution scheme that the landlord will determine at his fair and equitable discretion. In this case, billig does not refer to price, i.e. cheap, but derives from "recht und billig" - equitable, fair. Romain gives "discretion" for Ermessen. The best translation is discretion; i.e. discretion of the court or at one's own discretion (nach eigenem Ermessen)--Examples from Muret-Sanders; billig is used meaning angemessen= "reasonable" is the word mostly used in legal terms; equitable is implied in reasonable, but you could use equitable. It is not false. But it is better to say, i.e. that he exercises reasonable discretion in determining the distribution code.
