§ 2
Verpflichtete
(1) Durch diese Satzung wird verpflichtet, wer Zugangsdienste anbietet.
(2) Verpflichtete nach § 53 RStV und nach dieser Satzung sind auch die Betreiber von Kabelanlagen, soweit sie neben den im § 52 RStV beschriebenen Dienstleistungen Zugangsdienste anbieten.
(3) Wer Programme bündelt (aus mehreren eigenen oder fremden digitalen Programminhalten oder Diensten ein Gesamtangebot oder Programmpaket zusammenstellt) und vermarktet, ist Verpflichteter, sofern er eine marktbeherrschende Stellung innehat.

Berechtigte
Durch diese Satzung wird berechtigt, wer Zugangsdienste nachfragt, um eigene oder fremde Fernsehdienste oder mit ihnen inhaltlich verbundene Dienste anzubieten oder zu vermarkten.
§ 4
Allgemeine Anforderungen
(1) 1Verpflichtete müssen den Berechtigten Zugangsdienste zu angemessenen, nichtdiskriminierenden und chancengleichen Bedingungen anbieten. 2 Bietet ein Verpflichteter mehrere Zugangsdienste an, so gelten die Bestimmungen dieser Satzung für jeden Dienst einzeln.
