Bezüglich der Kaufpreisfinanzierungsvollmacht wird der die Grundpfandrechtsbestellung beurkundende Notar angewiesen, die Urkunden bezüglich der Bestellung von Grundpfandrechten in Urschrift, Ausfertigung oder beglaubigter Abschrift nur dann* in den Rechtsverkehr zu bringen* wenn der Käufer die Auszahlungsansprüche gegenüber den Darlehensgebern bis zur Höhe des Kaufpreises bzw. des noch offenen Kaufpreisrestes an den Verkäufer abgetreten und die Sicherungszweckerklärung entsprechend der obigen Vereinbarung eingeschränkt hat.
