Could somebody please tell me if Rechtsgewinn in a contract is the same as Rechtsgewinnung - ie creation of precedent? This comes on a clause about failure to notify defects and waiver of rights. Thank you.

...as in "to gain a right" and in contrast to "the loss of a right" (="Rechtsverlust"). I can't really see what this has to do with the word "precedent" (="Präzedenzenfall"). :-)
