Auch hier gibt es keinen englischen Kompaktbegriff. Wie auch im Falle des "Verfuegungsbeklagten" wuerde ich vorschlagen, den Begriff einleitend einmalig zu erlauetern und dann einfach "the patent" zu verwenden.

"The BGH has thus also recognised that such a wide interpretation of the assay privilege could lead to the holder of a drug patent running a dangerous risk and becoming sensibly impaired in the exclusive exploitation of his patent through a massification of assay projects. This would be likely to happen if third parties applied for and obtained patents of use due to successful trial results. In the opinion of the BGH, these are considerations to be taken into account, since the patent holder of a product, who is conceded the protection afforded by the patent, is only compensated for the contribution he has made to technology by making the product available. It is not necessary to also fully credit him for such applications of his product as may be discovered by virtue of the invention of a third party. In addition, the holder of the more recent patent of use may exclude the holder of the older patent of use from the application that is protected. His patent of use is, however, dependent upon the production patent. Since the holder of the more recent patent of use intervenes in the area protected by this patent, he cannot operate without the agreement of the holder of the production patent. The product patent retains its commercial value, in addition, as a result of the dependent character of the patent of use, because the holder of the more recent patent, the exploitation of which requires the agreement of the holder of the older patent; and the older patent thus retains its full validity in relation to protected use with regards to third parties."

Explanation:
An "einstweilige Verfügung" is a "preliminary injunction". Since "Verfügungspatent" is supposed to be an abbreviation for the patent which is the subject of a preliminary injunction, and I do not think that there is an abbreviation for this in English, I would probably write exactly that: "the patent which is the subject of the preliminary injunction". However, if a short form is to be used, I can only think of "injunction patent".
