In einem Pachtvertrag zwischen einer österreichischen Behörde und einem gewerblichen Pächter heißt es:
"Verletzt die Bestandnehmerin die Betriebspflicht gemäß § x dieses Bestandvertrags, so ist diese Verletzung - unbeschadet weiterer Ansprüche der Bestandgeberin, insbesondere auf Vertragszuhaltung, Schadenersatz und vorzeitige Auflösung oder ***Aufkündigung*** des Vertrages gemäß § y dieses Bestandvertrags, gemäß § z dieses Bestandvertrags pönalisert."
In § y heißt es:
"Die Bestandgeberin ist darüber hinaus berechtigt, das Bestandverhältnis aus wichtigem Grund mit eingeschriebenem Brief mit sofortiger Wirkung zur Auflösung zu bringen." [Es folgt eine Auzählung der Vertragsverletzungen, die als wichtige Gründe angesehen werden.] " Die genannten Gründe stellen zugleich wichtige und bedeutsame Umstände dar, die die Bestandgeberin zur Kündigung berechtigen."

Frage:
Ist "Aufkündigung" etwas anderes als "Auflösung"?
Ich habe "Auflösung" mit "termination" übersetzt. Wie ist dann "Aufkündigung" zu übersetzen?

Explanation:
Different emphasis to Auflösung as 'zum Datum ... aufkündigen' means give notice to terminate/taking effect (lease: notice expiring) on that date. Zum Datum ... auflösen would mean the actual terminating the contract on that date.

Aufkündigung: 'Willenserklärung, mit der ein unbefristetes Vertragsverhältnis beendet wird (z.B. Mietvertrag)': Österr. RechtsWB/Russwurm-Schoeller.
