Das Argument, es sei zwischen der gesetzlichen Verpflichtung und dem zusaetzlichen Geschaeft im Sinne der GoA (Geschaeftsfuehrung ohne Auftrag) zu unterscheiden, ist eine rein ergebnisorientierte leere Rechtsbehauptung, die auf die Schaffung "auch-fremder" Geschaefte im oeffentlichen Recht hinauslaeuft.

the "auch" refers to the argument, i.e. ...is a purely legal specious argument aimed at obtaining a [desired] result that also falls short of creating arms-length transactions ...

That's how I read it anyway.
