Newscorp points out that in Tetra Laval BV v. Commission(54) the Court of First Instance held that the standard of proof was the balance of probabilities and rejected the Commission's approach (namely that a possibility of harm to competition was sufficient to justify a prohibition decision).

agree  Dr. Fred Thomson: As a lawyer, I agree with "standard of proof." "Sufficiency of proof" might be tempting, but this term is narrowly defined and is not a correct translation of the German term. "Degree of proof" is extremely close and might very well be used, but IMO

agree  Axel Seyler (X): Kim, without exhaustive research of German and US law, I think that this is probably close enough. "Evidentiary standards" would probably sound a little more professional. Another choice would, in my view, be "sufficiency of the evidence". a common term
