I don't know about patents specifically but in a normal lawsuit, a Hilfsantrag is made at the same time as the original application. If you don't get what you really want (Hauptantrag), then the Hilfsantrag is second best. How you translate it depends on how you translate 'Antrag' if at all. e.g. in certain circumstances

Explanation:
I am beginning to find this peer grading *intensely* irritating.

I. Drumsey asked a specific clear question - s/he wanted to know at what point the Hilfsantrag was made. I answered that question. In my answer I used 'you' as a standard low register form of 'one'.
To clarify; a Hilfsantrag is submitted coincident with a Hauptantrag so that the applicant has a chance to get his/her/its 'second best' solution.

II. Eventualantrag is a synonym in EXACTLY this context. I quote Creifelds - one of the two authorative monolingual dictonaries on the market: "Hilfsantrag: (Eventualantrag) ist ein Antrag der nur für den Fall gestellt ist, dass der in erster Linie gestellte Antrag keinen Erfolg hat" (at p. 654)
