German term or phrase: höherer Schaden
"Im Falle des Zahlungsverzuges ist der Lizenzgeber berechtigt, von dem betreffenden Zeitpunkt an Zinsen in Höhe von 3% über dem Zinssatz der Europäischen Zentralbank als pauschalen Schadensersatz zu verlangen. Sie sind dann niedriger anzusetzen, wenn der Lizenznehmer eine geringere Belastung nachweist; der Nachweis eines höheren Schadens durch den Käufer ist zulässig."

What does "höheren Schadens" mean in this context? I'm fine up until that point. Does it mean "force majeure"?

Note that the plural "damages" would be appropriate..NOT "damage"

I think you're thinking of 'höhere Gewalt', which is an act of God.

In this case, it's actually simply that the purchaser can claim for more damages if he/it can evidence it has sustained them.

A search on 'höherer Schaden' + English on Google brings up a few translations of German AGB's ... which might or might not be useful!
